ARTWYRK — TERMS OF SERVICE

Welcome to ArtWyrk. These Terms of Service ("Terms") govern your access to and use of the ArtWyrk website, applications, AI services, and related products (collectively, the "Service"). By creating an account or using ArtWyrk, you agree to these Terms. If you do not agree with these Terms, please do not use the Service.

Our Mission
ArtWyrk exists to help artists, makers, crafters, designers, writers, and other creative entrepreneurs spend less time managing their businesses and more time creating.

Our goal is to build tools that empower creativity—not replace it.

Eligibility
 • You must be at least 13 years old to use ArtWyrk.
 • If you are under the age of majority where you live, you must have permission from a parent or legal guardian.

Your Account
You are responsible for:
 • Maintaining the security of your account
 • Protecting your password
 • All activity that occurs under your account
 • Providing accurate account information

You agree not to impersonate another person or create accounts using false information.

Ownership of Your Content
You retain ownership of all artwork, writings, business information, images, files, notes, and other content you create or upload to ArtWyrk.

ArtWyrk does not claim ownership of your creative work. By uploading content to ArtWyrk, you grant us a limited license to store, process, and display that content solely for the purpose of providing the Service to you.

AI Services
ArtWyrk includes AI-powered features and assistants designed to support creative entrepreneurs. These assistants may include:
 • Cosmo
 • Cora
 • Creo

The responses generated by AI are intended to assist you but should not be considered legal, financial, tax, accounting, medical, or professional advice. You remain responsible for decisions you make using AI-generated information.

Acceptable Use
You agree not to use ArtWyrk to:
 • Violate any law or regulation
 • Infringe another person's intellectual property
 • Upload malicious software
 • Attempt unauthorized access to systems
 • Disrupt or interfere with the Service
 • Harass, threaten, or abuse others
 • Use the Service for fraudulent purposes

We reserve the right to suspend or terminate accounts that violate these Terms.

Intellectual Property
The ArtWyrk name, branding, logos, interface designs, software, AI systems, graphics, and original content created by ArtWyrk remain the exclusive property of ArtWyrk unless otherwise stated.

These Terms do not grant you ownership of ArtWyrk's intellectual property.

Third-Party Services
ArtWyrk may integrate with third-party services including:
 • Google
 • Stripe
 • Printify
 • QuickBooks
 • Email providers
 • AI providers
 • Other integrations selected by the user

Your use of those services is governed by their own terms and privacy policies. ArtWyrk is not responsible for third-party services or outages beyond our control.

Payments
Some features of ArtWyrk may require a paid subscription. Prices, billing terms, and available plans may change over time. Unless otherwise stated:
 • Subscription fees are billed in advance.
 • Payments are non-refundable except where required by law.
 • Failure to pay may result in suspension of premium features.

Beta Features
ArtWyrk may offer beta or experimental features. These features may:
 • Change without notice
 • Contain bugs
 • Produce unexpected results
 • Be discontinued at any time

Your use of beta features is voluntary.

Availability
While we strive to provide reliable service, we cannot guarantee uninterrupted availability. ArtWyrk may occasionally experience:
 • Maintenance
 • Service interruptions
 • Software bugs
 • Third-party outages

We are continually improving the platform but cannot guarantee continuous operation.

Account Termination
You may stop using ArtWyrk at any time. We may suspend or terminate accounts that:
 • Violate these Terms
 • Abuse the Service
 • Engage in fraudulent activity
 • Create security risks

Where appropriate, we may provide notice before termination.

Disclaimer of Warranties
ArtWyrk is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties regarding:
 • Accuracy
 • Reliability
 • Availability
 • Fitness for a particular purpose
 • Uninterrupted operation

Limitation of Liability
To the maximum extent permitted by law, ArtWyrk and its owner shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service.

Our total liability for any claim relating to the Service shall not exceed the amount you paid to ArtWyrk during the twelve (12) months preceding the claim.

Indemnification
You agree to indemnify and hold harmless ArtWyrk from claims, damages, liabilities, and expenses arising from:
 • Your use of the Service
 • Your uploaded content
 • Your violation of these Terms
 • Your violation of another person's rights

Changes to These Terms
 • We may update these Terms from time to time.
 • When material changes are made, we will update the Effective Date and provide notice where required.
 • Your continued use of ArtWyrk constitutes acceptance of the revised Terms.

Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Washington, United States, without regard to conflict of law principles.
