WELCOME TO ARTWYRK

ArtWyrk is an AI-powered business companion designed for artists, makers, crafters, and creative entrepreneurs.

ArtWyrk exists to help creators spend less time managing the logistics of running a creative business and more time creating.

By accessing or using ArtWyrk, you agree to be bound by this End User License Agreement ("Agreement"). If you do not agree to these terms, please do not use ArtWyrk.

1. ABOUT ARTWYRK

ArtWyrk is operated by WyrkForge Studios ("WyrkForge," "we," "us," or "our").

ArtWyrk is designed around three core functions:

ORGANIZE — Reduce the operational chaos surrounding creative work.

CREATE — Develop artistic skill, creative confidence, and professional communication.

GROW — Support sustainable creative careers and business development.

Our goal is to return time to creators so that they can spend more of their lives doing the work that matters to them.

2. CREATOR-FIRST PRINCIPLE

ArtWyrk is built on a creator-first philosophy.

Our technology is intended to increase human capability, confidence, independence, and creative freedom.

AI within ArtWyrk is designed to function as a companion, mentor, educator, organizer, and strategic assistant.

It is not intended to replace the creator.

The creator remains responsible for their own ideas, artistic decisions, creative work, business decisions, and professional judgment.

Your work is yours. Always.

3. ELIGIBILITY

You must be at least 13 years old to use ArtWyrk.

If you are under the age of majority in your jurisdiction, you may use ArtWyrk only with the involvement and permission of a parent or legal guardian where required by applicable law.

By using ArtWyrk, you represent that you meet the applicable age and eligibility requirements.

4. YOUR ACCOUNT

You may be required to create an account to access certain ArtWyrk features.

You agree to provide reasonably accurate information and to keep your account information current.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You agree to notify WyrkForge Studios promptly if you believe your account has been accessed without authorization.

5. YOUR CREATIVE WORK AND CONTENT

You retain ownership of the creative work, artwork, writing, images, files, business information, notes, and other materials that you provide to ArtWyrk ("User Content"), subject to rights you may separately grant to third-party services you choose to connect.

ArtWyrk does not claim ownership of your artwork, creative identity, business, or intellectual property.

By using ArtWyrk, you grant WyrkForge Studios only the limited rights reasonably necessary to host, store, process, display, transmit, and otherwise use your User Content to provide and maintain the ArtWyrk services you request.

We do not acquire ownership of your creative work through your use of ArtWyrk.

6. CREATIVE DNA

ArtWyrk may develop a personalized Creative DNA profile based on information you voluntarily provide through your use of the service.

Creative DNA is intended to help ArtWyrk understand your goals, preferences, strengths, challenges, workflows, creative identity, and other information that can improve personalization.

Creative DNA exists to make your ArtWyrk experience more relevant and useful.

Creative DNA does not transfer ownership of your identity, ideas, artwork, or creative work to WyrkForge Studios.

Information concerning Creative DNA is also subject to the ArtWyrk Privacy Policy.

7. ARTWYRK EXECUTIVES

ArtWyrk may provide access to specialized AI executives, including members of the ArtWyrk Executive Team such as:

COSMO — Business organization and operational support.

CREO — Creative development, education, critique, and artistic guidance.

CORA — Business growth, strategy, opportunity development, and professional growth.

These executives may collaborate with one another to provide a more useful experience.

The executives provide recommendations, analysis, education, questions, organizational assistance, and other forms of AI-assisted support.

They do not become the owner of your work, business, creative identity, or decisions.

You remain in control.

8. ARTISTIC AUTHENTICITY

ArtWyrk is designed to strengthen the creator rather than replace the creative process.

ArtWyrk does not claim ownership of creative decisions made by users.

Where ArtWyrk provides critique, education, brainstorming, inspiration, writing assistance, or artistic guidance, the purpose is to help creators develop their own skills, ideas, judgment, and artistic voice.

ArtWyrk does not replace the artist.

The creator remains the artist.

9. AI LIMITATIONS

ArtWyrk uses artificial intelligence.

AI-generated information may contain errors, omissions, outdated information, misunderstandings, or inappropriate recommendations.

You are responsible for evaluating information provided by ArtWyrk before relying on it.

ArtWyrk does not guarantee that AI-generated recommendations or information will be accurate, complete, current, or appropriate for your particular circumstances.

Important decisions should be independently evaluated using appropriate information and professional judgment.

10. NO PROFESSIONAL ADVICE

ArtWyrk is a business companion and technology platform.

ArtWyrk does not provide legal, tax, accounting, financial, medical, investment, or other professional advice.

Information provided by ArtWyrk should not be treated as a substitute for advice from a qualified professional.

You remain responsible for determining whether a recommendation is appropriate for your circumstances and business.

11. THIRD-PARTY SERVICES AND INTEGRATIONS

ArtWyrk may integrate with third-party services, including services such as:

Google
Apple
Stripe
QuickBooks
Printify
Social media platforms
Cloud storage providers
Other services that may be added in the future

When you connect a third-party service, you authorize ArtWyrk to access information made available through that service for the purposes associated with the integration.

Your use of third-party services is subject to the terms, conditions, and policies of those third parties.

WyrkForge Studios does not control third-party services and is not responsible for their availability, functionality, policies, security, or changes to their products or APIs.

12. QUICKBOOKS INTEGRATION

If you choose to connect a QuickBooks Online account to ArtWyrk, you authorize ArtWyrk to access the QuickBooks information necessary to provide the functionality you request.

QuickBooks data accessed through your authorized connection remains subject to applicable QuickBooks and Intuit terms and policies.

You may disconnect your QuickBooks account through available ArtWyrk functionality or through the applicable third-party service.

ArtWyrk does not access your QuickBooks account unless you authorize the connection.

13. ACCEPTABLE USE

You agree not to use ArtWyrk:

• For unlawful purposes.
• To violate the rights of another person or organization.
• To infringe intellectual property rights.
• To upload malicious software, harmful code, or destructive content.
• To attempt unauthorized access to ArtWyrk or its systems.
• To interfere with or disrupt the operation of the service.
• To circumvent security, authentication, or access controls.
• To misuse third-party integrations.
• To attempt to reverse engineer or reproduce proprietary portions of ArtWyrk except where expressly permitted by applicable law.
• To use ArtWyrk in a manner that could reasonably harm other users, the service, or third-party systems.

14. ARTWYRK INTELLECTUAL PROPERTY

ArtWyrk, including its software, systems, interface, designs, branding, logos, documentation, proprietary technologies, and other materials provided by WyrkForge Studios, is owned by or licensed to WyrkForge Studios and is protected by applicable intellectual-property laws.

Nothing in this Agreement transfers ownership of ArtWyrk or WyrkForge Studios' proprietary technology to you.

You may not use ArtWyrk branding or proprietary materials in a manner that suggests an unauthorized affiliation, endorsement, or ownership.

15. SUBSCRIPTIONS AND PAYMENTS

Certain ArtWyrk features may require a paid subscription.

If you purchase a subscription, pricing, billing frequency, renewal terms, and cancellation options will be presented to you before purchase or otherwise made available through the service.

Payments may be processed through third-party payment providers.

Your use of third-party payment services may also be subject to their applicable terms and policies.

We may change subscription offerings or pricing in accordance with applicable law and the terms presented to you.

16. BETA FEATURES

ArtWyrk may periodically provide beta, preview, experimental, or early-access features.

Beta features may be incomplete, contain errors, change substantially, or be discontinued.

By participating in a beta program, you acknowledge that the feature is being developed and tested and may not perform identically to a production feature.

Additional beta terms may apply where specifically provided.

17. SERVICE AVAILABILITY

We work to make ArtWyrk reliable and useful, but we do not guarantee uninterrupted or error-free operation.

The service may occasionally be unavailable because of maintenance, upgrades, technical problems, security events, third-party service interruptions, or circumstances beyond our reasonable control.

We may modify, improve, add, remove, or discontinue features as ArtWyrk develops.

18. ACCOUNT SUSPENSION OR TERMINATION

You may stop using ArtWyrk at any time.

WyrkForge Studios may suspend or terminate access when reasonably necessary to:

• Protect the security of ArtWyrk.
• Prevent abuse or unlawful activity.
• Address violations of this Agreement.
• Comply with legal obligations.
• Protect ArtWyrk, WyrkForge Studios, users, or third parties.

Where appropriate and reasonably possible, we may provide notice before terminating or restricting access.

19. EFFECT OF TERMINATION

When your access to ArtWyrk ends, your right to use the service ends.

Certain provisions of this Agreement that by their nature should survive termination may continue to apply, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and governing law.

20. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARTWYRK IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WyrkForge Studios does not guarantee that ArtWyrk will always be available, uninterrupted, secure, error-free, or suitable for every particular purpose.

We disclaim warranties not expressly provided in this Agreement, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited by applicable law.

Nothing in this Agreement excludes or limits rights or remedies that cannot legally be excluded or limited.

21. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WyrkForge Studios WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF ARTWYRK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WyrkForge Studios' TOTAL LIABILITY ARISING FROM OR RELATED TO YOUR USE OF ARTWYRK WILL BE LIMITED TO THE AMOUNT YOU PAID TO WyrkForge Studios FOR THE SERVICE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in this Agreement limits liability that cannot legally be limited or excluded.

22. YOUR RESPONSIBILITY FOR YOUR BUSINESS

You remain responsible for your own business and creative activities.

This includes, without limitation:

• Your artwork and creative work.
• Your business decisions.
• Your pricing decisions.
• Your customers and clients.
• Your contracts.
• Your taxes and accounting obligations.
• Your compliance with applicable laws and regulations.
• Your intellectual-property rights.
• Your use of third-party platforms and services.

ArtWyrk provides tools and recommendations to support your decision-making.

You remain the decision-maker.

23. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless WyrkForge Studios and its officers, employees, contractors, and representatives from claims, damages, liabilities, losses, and expenses arising from your unlawful use of ArtWyrk, violation of this Agreement, or infringement of another person's rights.

This provision does not require indemnification to the extent prohibited by applicable law.

24. PRIVACY

Your use of ArtWyrk is also governed by the ArtWyrk Privacy Policy.

The Privacy Policy explains how ArtWyrk collects, uses, stores, protects, and manages information.

The Privacy Policy is incorporated into this Agreement by reference only to the extent necessary to describe ArtWyrk's privacy practices.

25. CHANGES TO THIS AGREEMENT

ArtWyrk is an evolving product, and this Agreement may need to change as the service develops.

We may update this Agreement from time to time.

When material changes are made, we may provide notice through the service or other reasonable means as required by applicable law.

The "Last Updated" date at the beginning of this Agreement indicates when it was most recently revised.

Your continued use of ArtWyrk after an updated Agreement becomes effective constitutes acceptance of the revised Agreement to the extent permitted by applicable law.

26. GOVERNING LAW

This Agreement is governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in this section limits rights that cannot legally be waived.

27. SEVERABILITY

If any provision of this Agreement is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

28. ENTIRE AGREEMENT

This Agreement, together with the ArtWyrk Privacy Policy and any additional terms expressly incorporated into the service, constitutes the agreement between you and WyrkForge Studios concerning your use of ArtWyrk and supersedes prior agreements concerning the same subject matter, except where otherwise expressly stated.
